On March 30, 1934, in the district court of Weld county, they were tried upon an information charging them with having murdered one Clifford Smith on February 27, 1934. The jury returned a verdict finding each guilty in the first degree and fixing the punishment at death. After the overruling of a motion for a new trial, and on April 9, 1934, sentence was passed upon the verdict by the court and defendants assign error.
