Summary judgment. The plaintiff, the widow of Morris Rabinovitz, commenced this action for the recovery of $20,000 as his beneficiary under a group life insurance policy issued by the defendant. Morris Rabinovitz was the president, general manager, and controlling stockholder of the Sheboygan Iron & Metal Company. Firms engaged in the scrap metal business formed an association which was named the Institute of Scrap Iron & Steel, Inc. The Sheboygan company was a member of the institute. Through its trustees the institute negotiated with the defendant for a group life insurance policy on the lives of certain employees of the employer members of the institute throughout the country. On October 21, 1957, the Sheboygan Iron & Metal Company made application to the institute and the defendant requesting that Morris Rabinovitz and two other employees be insured. The defendant issued its group life insurance policy on April 23, 1958, effective as of March 1, 1958. Morris Rabinovitz died on April 1, 1958.
